Complete Data Protection Information for suppliers & Business partners
1. Scope
This statement applies to you if you are a current or future Business partner of WashTec (e.g., a consultant or sole trader) or an employee of a Business partner who is in contact with WashTec on behalf of this Business partner.
2. Categories of personal data
In the course of our cooperation with Business partners, we process personal data of end users and contact persons at customers, interested parties, sales partners, suppliers and partners (each a "Business partner"):
i. Contact information, such as first and last names, business address, business telephone number, business mobile phone number, and business email address
ii. Organizational information, including position and company name,
iii. Contract and payment data, such as information required for the execution of contracts, payment transactions, or fraud prevention, including credit card information and card verification numbers
iv. Further information that is necessary for processing within the scope of a project or the execution of a contractual relationship with us or that is provided voluntarily by business partners, e.g. in the context of orders placed, inquiries, or project details
v. Personal data collected from publicly available sources (including company or professional social networks and websites), information databases or credit agencies, and
vi. Information that is legally required in the context of compliance and export control screenings, such as date of birth, nationality, place of residence, ID numbers, information on relevant court proceedings and other legal disputes in which business partners are involved.

4. Categories of recipients and international transfers
WashTec may disclose your business partner data to third parties for the following processing purposes:
Within the WashTec Group: WashTec and any company within the WashTec Group may receive your personal data for Processing purposes, in particular to carry out regular checks to ensure compliance with applicable laws and internal guidelines, and to respond to or comply with requests and legal requirements.
within certain acquiring or acquired companies: if WashTec's business is sold or transferred in whole or in part, or if WashTec acquires another entity and integrates it into WashTec's business (or if a similar transaction is sought), Your personal data may be transferred prior to the transaction (e.g., as part of due diligence) or after the transaction in accordance with the relevant legal provisions, including the legal system applicable to the other company.
To processors: certain third parties, whether or not they are affiliated companies, may receive your personal data in order to process such data in accordance with instructions ("processors") if this is necessary for the purposes of processing, in particular to provide IT and other administrative support (e.g., service providers who provide creditor support or IT hosting and maintenance support), to comply with applicable laws, and for other activities. Processors are contractually obligated to implement appropriate technical and organizational measures to secure personal data and to process personal data only as instructed.
Only those persons who need to know this information in order to perform their professional duties have access to your personal data. WashTec may disclose your personal data to government authorities, courts, external advisors, and similar third parties to the extent required or permitted by law.
International transfers
The personal data we collect and receive from you may be transferred to and processed by recipients located within or outside the European Economic Area ("EEA"). Some of the recipients outside the EEA are certified under the EU-US Data Privacy Framework and others are located in countries with existing adequacy decisions. In any case, a level of data protection recognized as adequate from a European data protection perspective will be ensured during the transfer. Other recipients may be located in countries that do not ensure an adequate level of data protection from a European data protection perspective. We will take all necessary precautions to ensure that all data protection security measures are taken when transferring data to countries outside the EEA. With regard to transfers to countries that do not ensure an adequate level of data protection, we will take appropriate security measures during the transfer, such as concluding standard contractual clauses of the European Commission or introducing approved codes of conduct together with binding and enforceable obligations on the part of the recipient. You can contact us as specified in Section 8 below and request a copy of such appropriate security measures.
5. Retention periods
Your personal data will be stored by WashTec and/or our service providers in accordance with applicable data protection laws, to the extent necessary to fulfill our obligations and only for the period necessary to fulfill the purposes for which the data was collected. If WashTec no longer needs your personal data, we will remove it from our systems and records and/or take steps to ensure that it is properly anonymized so that you can no longer be identified from it (unless we need to retain your data to comply with legal or regulatory obligations to which WashTec is subject).
Personal data in contracts, communications, and business letters may be subject to legal retention requirements that require retention for up to ten years. All other business partner data will generally be deleted five years after the end of the business relationship between you and WashTec.
6. Rights
Right to withdraw your consent: If you have given your consent to certain types of processing activities, you may withdraw this consent at any time with effect for the future. Such withdrawal will not affect the lawfulness of the processing carried out on the basis of your consent until withdrawal.
Right to object: Under certain circumstances, you have the right to object to the processing of your personal data by us at any time for reasons arising from your particular situation, and we are obliged to no longer process your personal data. If you have a right to object and if you exercise this right, your personal data will no longer be processed by us for these purposes. You can exercise this right by contacting us as specified in Section 8 below.
Under the EU General Data Protection Regulation, you also have the following rights:
If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 GDPR).
If incorrect personal data is processed, you have the right to have it corrected (Art. 16 GDPR).
If the legal requirements are met, you can request the deletion or restriction of processing and object to processing if this arises from your particular situation (Articles 17, 18, and 21 of the GDPR).
If you have consented to data processing or if a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).
You also have the right to lodge a complaint with a competent data protection supervisory authority in the relevant member state (e.g., in the member state of your habitual residence, place of work, or place of the alleged violation of the GDPR).

7. Contact form on our website
Description
The data you enter will be processed for individual communication with you and, if necessary, for the purpose of acquiring, surveying, and informing interested parties. For this purpose, we collect your full name (including title), contact details (such as address and email address), and the content of your request, depending on your request. This data and time stamps are used to assign your request and subsequently respond to it. The provision of further data is optional.
Legal
The data entered in the contact form is processed on the basis of our legitimate interest (Art. 6 para. 1 lit. f) GDPR) in processing your request. By providing the contact form, we would like to make it easy for you to contact us.
If you contact us to request a quote, the data entered in the contact form will be processed for the purpose of taking steps prior to entering into a contract (Art. 6 para. 1 lit. b) GDPR).
Recipients
The recipients of the data are any processors. A transfer to a third country is not planned.
Storage
Personal data relating to a pure enquiry will be stored for as long as is necessary to process the enquiry; as a rule, this data will be deleted at the latest 6 months after processing or completion of the enquiry. If a contractual relationship is established, we are subject to the statutory retention periods of the German Commercial Code (HGB) and will delete your data after these periods have expired.
Necessity
The provision of your personal data is voluntary. However, we can only process your request if you provide us with your name, contact details, and the reason for your request.

However, you can also assert your rights in relation to processing under joint responsibility against us. If you contact us, we will coordinate with the respective provider in order to answer your enquiry and ensure your rights as a data subject.
2. Subject matter of data protection
The subject of data protection is the protection of personal data. This is all information that relates to an identified or identifiable natural person (so-called data subject). This includes information such as name, postal address, e-mail address or telephone number, but also other information about your person that arises in the context of the use of our social media pages (e.g. connection and usage data).
3. General information on social media pages
We would like to point out that you use our social media pages and their functions as well as social media platforms on your own responsibility. This applies in particular to the use of interactive functions (e.g. liking, commenting, sharing, rating).
We expressly draw your attention to the fact that the respective providers may also store the data of their registered users (hereinafter "users") and other interested visitors to the social media platforms (hereinafter "visitors"), e.g. personal information, IP address, cookies, etc., outside the European Union (EU) or the European Economic Area (EEA) and use them for their own business purposes.
We generally have no influence on the collection of data and its further use by the providers. To what extent, where and for how long the data is stored, to what extent the providers comply with existing deletion obligations, which analyses and links are made with the data and with whom the data is shared is neither recognisable nor can be influenced by us. We therefore ask you to carefully check which personal data you disclose as a user on social media platforms.

4. Purposes and legal bases of data processing
Below you will find an overview of the purposes and legal bases of data processing. We operate our social media pages to inform users and visitors about our company and to exchange information with them.
Unless otherwise described below, your data is processed on the basis of our legitimate interests (Art. 6 (1) lit. f GDPR) in the economic operation, optimisation and usage analysis of our social media pages and in order to communicate with you as a user/visitor and to carry out advertising activities on the social media platforms.
It is sometimes possible to use our social media pages without registering with the social media platforms. Even if you use the social media pages without registering, personal data may be processed.
Below you will find an overview of the type, scope, purposes and, where applicable, specific legal bases of automated data processing in the context of the use of our social media pages.
4.1 Usage analysis
In connection with the operation of our social media pages, we use the "Insights" or "Analytics" function of the social media platforms, by means of which the provider provides us with statistical data on the use of our social media pages, which are anonymous to us, i.e. the personal data of individual users or visitors cannot be viewed by us. We do not know in detail which data the provider uses to analyse usage in connection with our social media pages. The legal basis for this is the legitimate interest pursuant to Art. 6 (1) lit. f GDPR in optimising our presence and offering.
In connection with the operation of our Instagram pages and Facebook pages, we use the "Page Insights" function from Meta (the provider of the services), which Meta uses to provide us with statistical data on the use of our Instagram and Facebook pages, which is anonymous to us, i.e. we cannot view the personal data of individual users or visitors. With regard to Page Insights data, we are jointly responsible with Meta for data processing and in this respect have concluded a joint controller agreement ("Page Insights Addendum" - https://de-de.facebook.com/legal/terms/page_controller_addendum ), in which our respective obligations under the GDPR are regulated. We have agreed therein that
- we are jointly responsible with Meta Platforms for the processing of Page Insights data
- Meta Platforms assumes primary responsibility and is primarily responsible for providing you with information about the joint processing and enabling you to exercise your rights under the GDPR (see section 8 below);
- Meta Platforms is solely responsible for making decisions regarding the processing of Page Insights Data and the fulfilment of its obligations under data protection law and, where applicable, implementing them;
- Meta Platforms is solely responsible for the processing of other personal data in connection with Page Insights that is not covered by the Page Insights Addendum; we cannot request disclosure in this regard;
- the Irish Data Protection Commission (https://www.dataprotection.ie) is the authority responsible for overseeing the processing under joint controllership.
From LinkedIn we receive, in particular, aggregated data in the following areas: Reach (impressions, page views, unique users, access to subpages), interaction (impressions, reactions, click rate, likes, shares, comments, (link) clicks, engagement rate), target group (demographic/geographic information)
With regard to Page Insights data, we are jointly responsible with LinkedIn for data processing and have concluded a joint controller agreement ("Page Insights Addendum" - https://legal.linkedin.com/pages-joint-controller-addendum), which sets out our respective obligations under the GDPR. In this agreement, we have agreed that
- we are joint controllers with LinkedIn for the processing of Page Insights data
- LinkedIn assumes primary responsibility and is primarily responsible for providing you with information about the joint processing and enabling you to exercise your rights under the GDPR (see section 8 below);
- the Irish Data Protection Commission (https://www.dataprotection.ie) is the authority exercising lead supervision over joint controllership processing.
From TikTok we receive, in particular, aggregated data in the following areas: technical data and usage data relating to how you interact with ads on TikTok, as well as data from other sources such as Facebook or Google), video views, profile views, likes, comments, shared content, gender and locations of followers, as well as follower activity in peak times, user data and event data.
4.2 Direct contact
If you contact us directly via our social media pages (e.g. via personal message, messenger or a pre-filled form), the data you provide (e.g. name, e-mail address, details of your vehicle, message content) will only be processed for the purpose of receiving and, if necessary, responding to your customer/prospect enquiry. We do not transfer this data to WashTec's internal systems.
As far as the initiation of a contractual relationship is concerned, the processing of data transmitted in the context of direct contact via the social media platform is based on Art. 6 (1) lit. b GDPR. Otherwise, data processing is based on our legitimate interest in responding to your enquiry in accordance with Art. 6 (1) lit. f GDPR. Insofar as we ask you for your consent to data processing, e.g. by means of a checkbox in connection with forms provided by us, the legal basis for data processing in this respect is Art. 6 (1) lit. a GDPR.
Since we are not aware of the confidentiality of the information you provide when contacting us directly and its use by the provider itself, please refrain from transmitting sensitive data or other confidential information, such as application documents or bank or credit card details. We recommend that you use a more secure means of transmission, such as letter post or our career portal at https://career.washtec.com/.
If you contact us directly as part of a job application, in particular via our Xing or LinkedIn page, and send us information about yourself, we will regularly delete such requests from the respective platform without undue delay.
4.3 Other user interactions
In accordance with the way a social media platform works, it is possible for us to gain knowledge of the users who like, subscribe to, rate, comment on or share our social media pages or our posts, provided that they have made their interaction on the social media platform public and have not expressly labelled it as "private" using the settings of the social media platform. We analyse this information in aggregated form in order to provide our users and visitors with more relevant content that may be of greater interest to you. The information obtained in this way does not allow any conclusions to be drawn about a natural person. Our legal basis for this is the legitimate interest pursuant to Art. 6 (1) lit. f GDPR in optimising our presence and offering.
In your respective social media profile, you as a user have the option of, for example, actively hiding your "posts", "tweets", "rated videos", "subscriptions", "followers", "pins" or other profile information or no longer following or subscribing to our social media pages. You will then no longer appear in the list of followers or subscribers to this social media page.
4.4 Interest-based advertising
We are able to carry out demographic and geographical analyses of our target groups provided to us by the provider in order to place targeted interest-based advertisements on our social media pages or to highlight our posts, but without obtaining direct knowledge of the identity of the user or visitor to whom the advertisements are displayed. In this case, the display of advertisements or highlighting of posts on our social media pages is based on an analysis of previous usage behaviour by the provider, whereby we only have anonymised or pseudonymised information, which regularly does not allow us to identify you personally and is not merged with any personal data stored by us at any time. The legal basis for the processing of pseudonymised data is the legitimate interest pursuant to Art. 6 (1) lit. f GDPR in optimising our website and offering.
If, in exceptional cases, we carry out an extended comparison with customer lists as part of interest-based advertising, this will only be done after you have given us your consent (Art. 6 (1) lit. a GDPR).
If you as a user have linked your Instagram account to your Facebook account, you can control the extent to which your user behaviour may be recorded and used by Facebook (on Facebook and Instagram pages) in the Facebook advertising preferences settings (https://de-de.facebook.com/ads/preferences).
As a Google user, you can control the extent to which your user behaviour may be recorded and used by Google in the data protection settings (https://policies.google.com/privacy?hl=de#infochoices).
As a user of the XING platform, you can control the extent to which your user behaviour may be recorded and used by XING in the data protection settings (https://privacy.xing.com/de/ihre-privatsphaere).
As a user of the LinkedIn platform, you can control the extent to which your user behaviour may be recorded and used by LinkedIn in the LinkedIn ad settings (https://www.linkedin.com/psettings/advertising).
As a user of the TikTok platform, you can manage your account, content and privacy settings in the TikTok security centre (https://www.tiktok.com/safety/de) and control the extent to which your user behaviour may be collected and used by TikTok.
5. Recipients of personal data
Within the WashTec Group, only those persons have access to your personal data who need it for the purposes stated in each case. We only transfer your personal data to external recipients if there is a legal authorisation or obligation to do so or if we have your consent.
Below you will find an overview of the relevant recipients:
- The provider of the respective social media platforms,
- Public authorities in the event of regulatory or legal violations.
6. Data processing in third countries
In principle, we only process data within the EU or the EEA. However, your data may also be transferred to third countries, such as the USA, in particular by the providers, whereby suitable protective measures are taken, such as the conclusion of the current standard contractual clauses, compliance with binding internal data protection regulations or your consent.
7. Storage period, deletion
We store your personal data, if legally permitted, only for as long as is necessary to achieve the intended purposes or for as long as you have not revoked your consent. In the event of an objection to processing, we will erase your personal data unless further processing is still permitted under the statutory provisions. We will also erase your personal data if we are obliged to do so for other legal reasons. Applying these general principles, we generally erase your personal data immediately
- after the legal basis ceases to apply and provided that no other legal basis (e.g. retention periods under commercial and tax law) applies. If the latter is the case, we will delete the data after this other legal basis no longer applies;
- if your personal data is no longer required for the purposes pursued by us and no other legal basis (e.g. retention periods under commercial and tax law) applies. If the latter applies, we delete the data once this other legal basis no longer applies.
We review the necessity of the personal data stored by us on the social media platforms at least once a year and carry out corresponding deletion routines, as part of which we initiate the removal of messenger messages, for example. However, due to our lack of technical control over the social media platforms, we cannot ensure that the social media providers will actually delete the data.
In principle, we have no influence on how the providers of the social media platforms store or delete your data on their platforms. For details on this, please refer to the

8. Rights of data subjects
According to the EU General Data Protection Regulation, you have the following rights:
If your personal data is processed, you have the right to obtain information about the personal data stored about you (Art. 15 GDPR).
If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR).
If the legal requirements are met, you can request the deletion or restriction of processing and object to processing if this arises from your particular situation (Art. 17, 18 and 21 GDPR).
If you have consented to the data processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).
Objection to direct marketing: If we process your personal data for the purpose of direct marketing, you have the right to object to data processing by us for this purpose at any time. If you exercise your right to object, we will cease processing for this purpose.
Withdrawal of consent: If you have given us your consent to process your personal data, you can withdraw this consent at any time with effect for the future. This does not affect the lawfulness of the processing of your data until you withdraw your consent.
You can contact the competent supervisory authority if you have any complaints about data protection.

Description of the processing activity
This data protection information serves to provide information regarding the processing of your personal data in connection with the CarWash Assist remote service.
WashTec provides a central hotline that car wash customers or staff of the Operator (hereinafter referred to as "car wash customers") can contact by telephone if they have any questions or problems regarding the use of the car wash system. The hotline staff provide support to callers by telephone and, if necessary, with the aid of video recordings from the car wash and around the car wash, i.e. in particular recording and confirming a request from the car wash customer, analysing the content of the request and resolving the request if possible.
Furthermore, video recordings are processed for complaint handling and damage settlement and can be forwarded to the Operator. The video recordings are also processed for the detection of anomalies in the vicinity of a vehicle wash (e.g. door or boot open, windows open, people in the movement area, etc.), whereby these video images are used to train an AI model and are also evaluated by AI.

The controller has collected your data directly from you or by means of video recording.
Recipients or categories of recipients of personal data
The recipient of the data is the controller, an affiliated company or a processor associated with these services or assisting in the provision and optimisation of the remote service.
Recipients may also be the respective Operator and, where there is a legal basis and necessity, authorities (including the police) and insurance companies.
Transfer of personal data to a third country

Under the EU General Data Protection Regulation, you have the following rights:
